Terms of Service

1. The Service

X₁ Genesis is a web-based market analysis and signal intelligence software system. It provides analytical tools, indicators, calculations, reports, market observations, and related software functionality.

X₁ Genesis is provided as analytical software. It is not a brokerage, exchange, investment adviser, financial planner, fiduciary, bank, custodian, or trade-execution service.

2. Subscription Access

Access to X₁ Genesis may require an active paid subscription. Subscription pricing, billing frequency, trial terms, and other commercial terms displayed at checkout form part of your purchase.

Unless otherwise stated at checkout, access continues while the applicable subscription remains active and in good standing. Cancellation prevents future renewal but does not necessarily terminate access before the end of the already-paid billing period.

3. License

An active subscription grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use X₁ Genesis for your own lawful purposes.

Purchasing access does not transfer ownership of X₁ Genesis, its software, algorithms, models, interface, branding, documentation, or other intellectual property.

4. Device Activations

Unless a different limit is expressly stated at checkout, a subscription may be activated on a maximum of two devices.

Activation limits exist to permit reasonable personal use while protecting the service against credential sharing and unauthorized distribution.

Attempting to circumvent activation controls, license validation, authentication systems, or other access restrictions is prohibited.

5. License Keys and Account Security

Your X₁ Genesis license key is an access credential. You are responsible for keeping it secure.

You may not publish, sell, sublicense, distribute, share, or otherwise provide your license key or authenticated access to another person except where expressly authorized by X₁ Genesis.

Access may be suspended or terminated when there is reasonable evidence of unauthorized sharing, abuse, fraud, circumvention, or other violation of these Terms.

6. Prohibited Uses

You may not:

• resell or redistribute access to X₁ Genesis;
• share licenses outside the permitted activation policy;
• attempt to bypass authentication or licensing controls;
• copy or redistribute proprietary portions of the service;
• reverse engineer the service except where applicable law expressly prevents such a restriction;
• interfere with the service, servers, APIs, or security systems;
• use automated methods intended to overload or abuse the service;
• use X₁ Genesis for unlawful activity; or
• misrepresent X₁ Genesis signals, outputs, or results as guaranteed investment returns.

7. Market Data

X₁ Genesis may rely upon market information obtained from third-party data sources, exchanges, APIs, or other providers.

Market data may occasionally be delayed, incomplete, unavailable, incorrect, revised, or interrupted. X₁ Genesis does not guarantee the accuracy, completeness, timeliness, or continuous availability of third-party market data.

8. No Investment Advice

X₁ Genesis provides software-generated analysis and information only. Nothing provided through X₁ Genesis constitutes individualized investment, financial, legal, accounting, or tax advice.

Signals, indicators, reports, calculations, classifications, market observations, or other outputs should not be interpreted as a promise, guarantee, or assurance that any asset will increase or decrease in value.

You remain solely responsible for evaluating any trade or investment decision.

9. Trading Risk

Trading and investing involve substantial risk, including the possible loss of some or all capital committed.

Past performance, historical signals, simulations, backtests, hypothetical results, or previous market behavior do not guarantee future results.

10. Service Availability

We aim to maintain reliable access but do not guarantee uninterrupted, error-free, or continuously available operation.

Access may be affected by maintenance, software updates, internet failures, exchange outages, API changes, third-party service interruptions, security events, or circumstances outside our control.

11. Changes to X₁ Genesis

X₁ Genesis may be updated, modified, improved, replaced, or have features added or removed as the system develops.

Nothing in a subscription guarantees that every feature, data source, interface element, calculation, or integration will remain permanently unchanged.

12. Intellectual Property

X₁ Genesis, including its software, design, algorithms, models, documentation, terminology, branding, graphics, interfaces, and proprietary analytical methods, is protected by applicable intellectual-property law.

Except for the limited right to use the service under these Terms, no rights are granted to reproduce, distribute, commercially exploit, or create unauthorized derivative versions of proprietary X₁ Genesis materials.

13. Payments

Payments may be processed by third-party payment providers and merchant-of-record services.

Their own payment, tax, refund, privacy, and processing terms may also apply to transactions completed through their systems.

14. Cancellation

You may cancel a recurring subscription using the customer-management options provided with your purchase or by contacting support.

Cancellation stops future renewals. Access may continue through the remainder of the period already paid for, subject to these Terms.

15. Refunds

Refund requests are evaluated according to the terms presented at checkout, applicable payment-provider policies, and applicable law. Nothing in these Terms limits any non-waivable consumer rights that apply to you.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, X₁ Genesis is provided on an “as is” and “as available” basis without warranties of guaranteed profitability, trading performance, uninterrupted availability, or error-free operation.

17. Limitation of Liability

To the maximum extent permitted by applicable law, the operator of X₁ Genesis will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of, or inability to use, the service.

This includes, without limitation, trading losses, investment losses, lost profits, lost opportunities, loss of data, or losses resulting from third-party data failures.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

18. Termination

Access may be suspended or terminated for material violations of these Terms, fraud, abuse, unauthorized redistribution, attacks against the service, attempts to defeat licensing controls, or unlawful use.

19. Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Subject to any mandatory rights or procedures available under applicable law, disputes concerning these Terms or X₁ Genesis shall be resolved in courts of competent jurisdiction located in Oklahoma.

20. Changes to These Terms

These Terms may be updated as X₁ Genesis evolves. The effective date displayed above identifies the current version. Material changes may be communicated through the service or other reasonable means.
